Google, BlackBerry EarthLink and Red Hat Take A Stand Against Patent Trolls, Ask FTC, DoJ To Do The Same

Media_httptctechcrunc_dtknb

Google, along with BlackBerry, EarthLink and Red Hat today appealed to the Federal Trade Commission and Department of Justice to take stronger action against companies like Lodsys, Intellectual Ventures, and other “patent assertion entities” (aka patent trolls or patent privateers) — companies they believe abuse patents for financial gain and are an increasing detriment to the technology industry, costing U.S. companies alone nearly $30 billion in 2011, “and $80 billion when accounting for all costs – direct and indirect.”

The four companies’ position was laid out in a lengthy comments document submitted to the Federal Trade Commission and Department of Justice. The 22-page report lays out how PAEs’ activities have evolved over the last several years; they claim that their licensing regimes and court cases cost the U.S. economy some $30 billion annually.

Crimes Against Content Makers In The Digital Age

Media_httpmedia02hong_sghkp

It is very easy to now write and be published online, even if you are halfway around the world. But it is much, much easier to have your content ripped off by unscrupulous parasites, who don’t want to put in the hours to create good content.

Some steal in parts, sometimes half-heartedly paraphrasing (to cover their tracks), sometimes using direct copy-and-pasting to take bits and pieces of a few articles to ‘produce’ their own piece. When you do this without crediting the original writer, this is called plagiarism.

Essential Guide to Copyright for Beginner Freelancers

Media_httpfreelancesw_jctin

As a creative professional, your work is often governed by copyright law.

It’s not exactly a topic that most of your clients will be familiar with, so you need to make a point of having practical expertise. You don’t need a law degree to know the applications of copyright law in your particular niche, though it never hurts to take a class or two in this topic.

A Lesson in Plagiarism

Media_httpfreelancesw_gjake

I had a crazy thing happen to me that I want to share because it is an important lesson to anyone who works hard to create great content for their blog or website.

Someone who reads my blog posts on FreelanceSwitch contacted me today about something she thought was fishy. She had seen a blog post about making the switch from full-time work to freelance that looked suspiciously familiar to one I had written for FreelanceSwitch a couple of weeks ago.

When I saw the blog post I was appalled. It wasn’t similar—it was EXACTLY the same! The only difference between in the content are the links inserted into the copy. Even the same stock photo that was purchased for the post appeared in this new blog.

How to Protect Your Design Work on the Internet

Media_httpcdndesignmo_edaas

Are you worried about people stealing your designs after you publish them on the web?

Web designers are faced with a “catch 22” situation. To attract new clients, they must showcase their work and put it on display on the internet. Yet, by doing so, they are more vulnerable to thievery. The possibility of people taking their work and re-publishing it or using it for their own gain without giving the author attribution is a grim reality.

It’s all too easy for internet users to click and save a graphic and insert it into a blog or website without the creator even knowing it is happening.

A Beginner's Guide to Patents, Trademarks and Copyright

Media_httpwwwopenforu_qtdfu

New ideas make the world of business go 'round, and small businesses are no exception. Such ideas can be the lifeblood for these businesses, which are often built around a new invention, product, process, service or idea.

But small-business owners often aren't sure what to do when they have a new idea. Should you get a patent? How can you protect your business interests? What's a trademark, anyway? And is copyright even something that concerns you?

To address those questions and others, here's a primer of the three intellectual property biggies: patents, trademarks and copyrights.

Help! There’s A Patent On My Idea! What Now?

Media_httptctechcrunc_dcscn

One of the most frequent questions I get asked goes something like this: “I have a really great idea, but (name of big company or university) has a patent on that. What do I do?” With over 8,000,000 patents issued to date and thousands of new patents issued weekly, chances are good that patents have been issued that are relevant to your business or idea. Knowingly infringing an active patent can lead to disastrous consequences for your business. So what do you do?

Well, those people who have asked a patent attorney have already taken the right first step. Patents are legal documents and can be incredibly difficult to understand for those who are not well versed in the language of “Patentese.” Talking to a patent attorney is invaluable when dealing with a patent issue. So what follows is a discussion of a few things that should be considered to help give a better understanding of the process and to show that it is not necessarily a hopeless situation.

10 Ways to Protect Your Intellectual Property

Media_httpwwwinccomup_ibchb

How important is intellectual property protection to your startup? Not too long ago, defensible IP was one of the top things venture capitalists wanted to see in a startup. But the success of several high-profile tech startups, such as Twitter and Facebook, that are relatively weak on patentable intellectual property, has caused many to rethink that assumption. After all, creating and maintaining a robust IP portfolio is expensive. Patents don’t determine whether a startup will be able to scale. And the lean startup model is all about getting to market fast with the minimum viable product. Launch first, patent later… if at all.

What Bloggers Should Know about Copyright

Media_httpfarm8static_dixai

Contrary to popular belief, the Internet is not a free-for-all. But the ability to copy and paste content from one page to another is just so easy, many people think that if it’s on the Internet, it’s up for grabs. The truth is that content is copyrighted from the moment it is created, protecting both the content and its author from theft. For bloggers, that means the content that your write is your own, and no one else has the right to use that content without obtaining the proper permission.

A 5-Minute Guide to More Persuasive Copywriting

Media_httpnetdnacopyb_qhghn

Copywriters love to tell clients they can create compelling copy.

Few of them ever mention whom they think they’re compelling.

That’s because too few of them have ever given it the thought it deserves.

One of the first rules of copywriting is to know your audience, and many copywriters are fairly skilled at creating copy designed to appeal to, say, a 60-year-old female retiree who’s confused about her insurance options.

The Trademark For "Kindle Fire" Isn't Registered to Amazon

Media_httpstatic5busi_lupje

Amazon could potentially be spinning off its Kindle Fire business into a separate company called Seesaw, reports Fusible.
This comes from looking up the trademark filings for Kindle Fire and Kindle Silk -- they're registered to Seesaw, LLC, not Amazon. Check it out on the USPTO's site here.
This doesn't conclusively indicate a split, though. CNN writer Mark Millian tweeted that just because the trademarks are filed to a different company doesn't mean there's a split happening.

Five Copywriting Errors That Can Ruin A Company’s Website

Media_httpmediasmashi_iiyxh

No matter how brilliant a website’s design, no matter how elegant its navigation, sooner or later visitors will decide whether to take action because of something they read. In the end, the effectiveness with which a website converts visitors hinges on words. If a new website is going to hit all the right notes, its content must be just as well crafted as its design and programming. However, as you might imagine, there are many ways to go wrong with content in a Web development project.
